1. Can I take Defensive Driving to have my ticket dismissed?

It must be a moving violation and you must be elibible to take the defensive driving class.

2. How do I know if I am eligible to take defensive driving?

If none of the following pertain to you, you will be eligible to take Defensive Driving:

Person's holding a commercial driver's license at time of offense; non Texas driver's license; speeding 25 mph or more over the posted speed limit; committing a traffic offense in a construction zone when workers are present; passing a school bus loading or unloading children; if you have taken the class for another ticket dismissal within a year or you are currently taking the class for another ticket dismissal.

3. How long do I have to take the defensive driving class?

You have 90 days from the date you come in to request the Driving Safety Course (DSC) and sign the affidavit.

4. What are the requirements to take a defensive driving class?

1. Come to the Court Clerk window on
or before your court date to request the Driving Safety Course or you may appear on your court date before the judge.
2. Plead guilty or nolo contendere(No Contest) and waive a jury trial;
3. Pay court costs in the amount of $107.00 unless the offense occurred in a school-crossing zone, then pay court costs in the amount of $132.00.
4. Present to the court a valid Texas Drivers license or permit;
5. Present to the court proof of financial responsibility in your name (automobile liability insurance)

5. Can I show my proof of insurance at the clerk's window?

NO, you must appear before the judge on your court date.

6. Can I show proof that I have renewed my inspection sticker or registration sticker at the clerk's window?

NO, if you have renewed your stickers you will have to appear in court on your court date before the judge and present him with proof that your stickers have been renewed.

7. How do I reset my court date?

All court date resets must be done in person.

8. Can I reset my court date the same day I have court?

NO, all resets must be done prior to the court date.

9. If I have a trial date can I reset my court date?

To reset a trial date you must post a cash bond in the amount of the citation.

10. Can I reset my court date over the phone?

NO, all court dates must be reset in person, if you are attending court for the first time and have an arraignment date, the reset will be for one week and one time only. If you need more time, you must attend court on the given court date and talk to the judge about a later date.

11. When do I have to pay the court costs?

When you come in to request the Driving Safety Course (DSC), you must pay the court costs at that time, if you are unable to pay the DSC you will have to appear in court before the judge.

12. Can I be placed on a payment plan?

In order to be placed on a payment plan, you must appear in court on your court date before the judge.

13. Can I be placed on a payment plan on a warrant?

NO, all warrants must be paid in full.

15. Will I have to pay a fine if I have renewed my stickers?

That will be up to the judge. They look at how long the sticker was expired and how long it took you to get them renewed, if the charge is not dismissed with a fee, the judge might reduce the fine.

YES, there is a $3.00 service fee when you use a VISA or MASTERCARD.

17. What credit cards do you accept?

Visa and Mastercard only

18. Can I show up to court at anytime?

NO, you must be on the docket. Therefore, you must come in on your court date.

19. Can I pay with someone else's credit card?

If you are going to pay with someone else's credit card the card holder must be present with a Valid ID.

20. Can I enter the court room with my cell phone?

NO, cell phones are not allowed in court room at all - even if they are turned off.

21. Can I pay with someone else's check?

NO, the check must be in the name of the person that received the citation and no temporary checks are accepted.

22. Can I get a marriage license at your office?

NO, marriage licenses must be obtained at Harris County Courthouse. You may contact the Bellaire Library for further information at 713-662-8160.

23. Can I bring a book or newspaper to court?

NO, reading materials are not permitted in the court room.

24. Can I bring my kids to court?

NO, if you bring your kids with you to court, let the baliff know and the judge will see you at the end of the docket.

1. What are the requirements for starting new water, sewer, garbage and recycling service?

The Owner/Tenant must know who they buging/renting the property from. The applicant must go to the second floor of the City Hall Building at 7008 S. Rice Ave and fill out the contract in person. There is a deposit and service fee required at time of service request. The current Deposits are Owner $40.00, Tenant $100.00, and Commercial $100.00. There is also a $25 Service Fee at this time, the deposit is refundable after 12 months of service.

2. When is my bill due?

Every 2nd Friday of the month before end of business day. Our office hours are 8am - 5pm, Monday - Friday. Cash, Personal Checks, and Money Orders are accepted at this time.

3. Where can I pay?

You may mail your payment in the envelope you received with your bill.
You may drop off your payment at the City Hall Building at7008 S. Rice Ave on the second floor or drop off your payment in the Night Deposit Box located next to the glass doors on the front of the City Hall Building facing S. Yes, each month meters are read for billing purposes.

No, the City does not make any leak adjustments on water bills. The Owner/Tenant/Landlord is resposible for any water that has passed through and registerd on the meter. Also, the City of Bellaire does not make any adjustments on any type of pool filling.

6. Where can I purchase garbage bags?

The only place you can purchase garbage bags is at the City Hall Building on the second floor located at 7008 S.Rice Ave between the hours of 8-5pm, Monday - Friday. Each roll is $5.95, including taxes.

Fire Department - Business Questions

1. My building has a sprinkler system. Are there things I should do to maintain the system?

If you own the building, you are required to see that the system is tested annually by a reputable contracted agency and the documentation of this test should be kept on file for the fire department to view in accordance with International Fire Code chapter 9. If there is a system in your building it must be in operational condition at all times. If you are a tenant or owner-occupant, there are other things you can do to be sure your system is ready in case it is needed. Never paint a sprinkler head. Each sprinkler head is designed to cover a certain amount of area in your building so before you build walls or large shelving units or stack storage to the ceiling, check with your fire inspector to be sure what you do won’t prevent the sprinkler head from doing it’s job. Also, never hang anything from a sprinkler head.

2. On TV, when a sprinkler head begins to spray water, they all do. Is this how my sprinklers will work?

No, most sprinkler systems with a few exceptions, (and those are found only in heavy industry situations), are designed to activate only where the fire is. The heat from the fire activates the sprinkler head closest too it. If the fire is large enough it may activate more than one head in the area but it will not activate every head on an entire floor.

3. The Fire Department has been inspecting my building for many years and has never mentioned a violation in the past. Why are they indicating a violation this time?

Fire codes are updated regularly. Some of the things that cause changes in these codes may be a newer type of construction, a new construction method or an event that occurred where people were injured. Whatever the reason, when the codes are updated, it is necessary to inspect your facility under the most current code. This may result in a change from the previous year in your inspection

5. My building has a fire alarm system. Are there things I should do to maintain the system?

Also, it would help if someone who is likely to be in the building on a daily basis knows where the alarm panel is located. If you are a tenant or owner-occupant, there are other things you can do to be sure your system is ready in case it is needed. Never paint a detector surface. Each detector is designed to cover a certain amount of area in your building so before you build walls or large shelving units or stack storage to the ceiling, check with your fire inspector to be sure what you do won’t prevent the detector from doing it’s job. Also, never hang anything from a detector.

6. Our alarm system keeps having false alarms. The alarm goes off but no fire is found. Can’t we do something about this?

Fire alarms seldom malfunction. Usually, if they are sounding, there is a reason. Sensing devices may need cleaning or replacement. Other reasons causing alarm activation may be as simple as a bag of popcorn that overcooked in a microwave, a co-worker smoking in an area where they shouldn’t be, or dust from re-modeling. In all of cases, even though big flames were not shooting from the building and hoses were not needed to put the fire out, the system was doing its job of alerting everyone in the building to a possible danger of a fire. If your system activates, immediately leave the building and do not re-enter until the proper authority investigated the alarm and gives the all clear to enter the building. Take every fire alarm seriously, follow your established evacuation plan, leave the building until someone of authority (building maintenance, security, the fire department, etc.) tell you it is safe to return.

7. Is there a requirement for a Fire Drill in my building?

Yes, the International Fire Code requires an annual fire drill. Bellaire Fire Department has adopted a “down and out” policy. This differs from the City of Houston where tenants only have to go to the stairwell. We believe that the drill must simulate a real scenario to be useful.

9. If during an inspection a violation is found how long do I have to fix it?

For a routine (non-life threatening) violation we usually grant 10 business days for correction. If a life threatening violation is found we require it to be corrected immediately. If a violation cannot be corrected in the amount of time given then we will work with the owner/occupant to ensure compliance as quickly as possible.

Bellaire Fire Department only does CPR training in conjunction with CERT. There will be 30 positions available to the public, on a first come first serve basis.

5. Does Bellaire Fire Department still sell smoke detectors?

No, there are multiple organizations that sell detectors for the same amount or less than Bellaire Fire Department can. We will help install the detectors for Senior Citizens and provide on-site information on the proper place to install for all others.

6. Does the City Of Bellaire allow open burning?

No, city ordinance does not allow any type of open burning. Flames used to smoke or Bar-b-que are acceptable.

7. Does the Bellaire Fire Department fill swimming pools?

No, this is the responsibility of the homeowner or pool company

8. Where should a Fire Extinguisher be placed in the home?

Having a fire extinguisher in the home is a good idea, but not mandated by the Bellaire Fire Department. If you have an extinguisher, it should be placed where it is easily accessible. The kitchen and garage are good sites for an extinguisher. However, do not place an extinguisher over the stove or buried in storage in the garage, but rather hang it on the wall no less than 4 inches or greater than five feet from the ground.

9. I’ve heard quite a lot about carbon monoxide. Could I have this in my house and do I need a carbon monoxide detector?

There are many things that give off carbon monoxide. They include gas appliances such as furnaces, water heaters and stoves. Fuel burning space heaters and wood burning fireplaces can give off carbon monoxide. Even warming up your car or barbecuing in your garage can fill your house with carbon monoxide. The problem is that it is an odorless, colorless gas so until you begin to see symptoms, you don know it’s there. People experiencing carbon monoxide poisoning feel like they have a flue that came on suddenly. This also affects small pets and even plants. Carbon monoxide detectors will sense excessive levels of the gas early and warn you to leave.

24. What is the mosquito spray schedule?

The Mosquito Control Program uses environmentally friendly fog to control mosquito populations in Bellaire. Spraying in Bellaire begins when Harris County Mosquito Control begins to spray. Typically this begins in May and lasts until October. The City may spray earlier or later to reduce mosquito populations.

The spraying occurs weekly as follows:
Tuesday nights after 10:00 pm all areas inside Loop 610
Wednesday nights after 10:00 pm all areas outside Loop 610

The spraying cycle can be adjusted due to weather or other conditions.

The City offers a “No Spray Request” for its citizens who do not want the spraying to occur near their home. The citizen needs to contact the Parks and Recreation Department to request the “No Spray Request” form and return it completed to the Recreation Center.

Yes, all Bellaire City Library material that will fit in the opening of the bookdrop can be returned there.

6. My movies and books are due today. Will I be charged an overdue if I put them in the bookdrop?

If the material is put in the bookdrop before the library is opened the next day, it is considered to have been returned on the previous day. In other words, if your movie is due on Tuesday and you put it in the bookdrop before 9:00 am on Wednesday, it is not considered overdue.

7. Are fines charged on the weekend and holidays?

Yes, fines are charged on Sundays and all holidays. You can always return the material in the bookdrop to stop the fine.

8. Can I return my books and movies to any library?

All material checked out from the Bellaire City Library must be returned to Bellaire City Library. Fines will be charged until the material is returned to Bellaire.

9. Is my PowerCard accepted at the Bellaire City Library?

The PowerCard can only be used at a Houston Public library. Harris County Library also has a separate card.

10. Can I use my personal laptop at the library and get on the web?

Yes. The library is wireless and there is no charge to connect.

12. I've lost my library card what do I do now?

Any lost card needs to be reported to the library immediately so that you are not responsible for any unauthorized use on the card. A replacement card will be issued for $1.00.

13. My purse/wallet was stolen with my library card in it.

Please report the theft as soon as possible to avoid unauthorized use.

14. How do I put a book or movie on hold?

You may come into the library or call 713.662.8160 as ask library staff to assist you. Holds may also be placed online through the catalog with your library card.

15. Does the library have a copier I can use?

The library offers a color photocopier that also prints in black and white. Black and white copies are 10 cents and color copies are 50 cents.

16. Do you have a typewriter I can use?

A typewriter is available for $1.00 an hour or any part of an hour. You will need to provide your own paper.

17. What if I lose my book or movie?

Any material that has been checked out and has been lost will need to be paid for by the borrower. The cost of the material plus a $5.00 processing fee will be charged in addition to any fines. If the material is found within 90 days from date of payment, then the cost of the material will be refunded. Fines and processing fees are not refunded.

18. Is there a fax machine?

Faxing is available for $1.00 per page for local calls, $2.00 for long distance calls and $3.00 for international calls.

1. Can I rent the Evergreen or Bellaire Town Square Family Aquatic Center swimming pools for a private party?

Yes. To make arrangements for pool parties during the swim season, contact the Aquatics Supervisor by phone at 713-662-8242 or a Recreation Specialist at 713-662-8287.

2. Do I have to be a Bellaire Resident to take a class or use the Recreation Center?

No. Non-residents are welcome to take part in all of our activites, however there will be a separate Non-resident fee for most activities.

3. Who do I contact to sign my child up for Little League or Bellaire Soccer Club?

4. Can I sign-up my friend’s child for Summer Day Camp?

No. You can only sign-up your children or the children that are in your care, ie you are considered to be their guardian. If you will be out of town on the day of registration, you will have to attempt to sign your child up at a later date. We do not accept early registrations.

5. When is Summer Day Camp registration?

Camp Paseo Summer Day Camp registration is typically the first weekend in March. This year Bellaire Resident registration is scheduled for March 1, 2008. Earlybird Online resident registration will begin February 23. Non-resident registration will begin March 10, 2008.

6. Does the City of Bellaire rent facilities for events such as wedding receptions, parties, etc.?

7. What is the mosquito spray schedule?

Mosquito spraying typically occurs weekly between April and October. All areas inside Loop 610 are sprayed on Tuesday nights and areas outside of the Loop are sprayed on Wednesday nights. This schedule may be adjusted due to weather or other conditions. If you have questions about the mosquito spray schedule, contact the Parks Superintendent by phone at 713-662-8116 or 713-662-8280.

8. Do I need to reserve a park facility to have a private party?

No. All park facilities are first come – first served. The Evergreen swimming pool can be rented for private pool parties. To make arrangements for pool parties, contact the Aquatics Supervisor by phone at 713-662-8600 or a Recreation Specialist at 713-662-8287.

9. Who do I contact about a park maintenance request?

You will first need to know what your Zoning District designation is. You may obtain that by calling the Permitting Office at 713-662-8230/8231/8243. 7. What are the collection requirements for garbage and tree limbs?

Per the City Code of Ordinances Sec. 16-2. Collection requirements:

Garbage shall be placed in plastic bags, having a minimum thickness of 1.5 mil and a capacity of not less than 20 gallons each and which will not leak when handled. Such bags shall be tightly closed by cord, wire, or rubber band, in such manner as to prevent leakage of contents. Paper bags may be used under the same terms and conditions as plastic bags, provided such paper bags consist of at least two sheets of 50 pound wet strength extensible paper. Empty cardboard boxes must be broken down and bundled prior to collection.

All tree limbs shall be cut in lengths not to exceed four feet. Limbs cut in lengths as herein required shall be stacked at the curb in piles not to exceed five feet in height. Tree limbs placed at the curb for collection shall be separated from all other types of refuse. All brush clippings are to be placed in plastic bags for collection.

8. What is the maximum amount city will haul per day per premises?

Per the City Code of Ordinances Sec. 16-4. Maximum amount city will haul per day per premises:

Not more than 300 pounds of garbage shall be hauled away in any one day from any one residential or business establishment by the garbage collectors of the city. Any garbage at any such establishment in excess of 300 pounds shall be hauled away to a proper place of disposal outside the City of Bellaire, at his expense, by the occupant of the property where it is gathered, or by the person or persons gathering it, within 48 hours after it is gathered.
